Terms of Service

These Terms of Service (“Terms”) govern your use of Upform, operated by Neuralps Sàrl (CHE-425.172.760), Chemin de la Mousse 80, 1226 Thônex, Switzerland. By creating an account or using the service, you accept these Terms. If you do not agree, do not use Upform.

Upform is an AI-assisted triathlon coaching service. It connects to your Intervals.icu account to build an adaptive training plan, adjust it to your recent training and wellness, and push workouts to your calendar.

Plans and feedback are generated by artificial intelligence from the data you provide. They may contain errors or be unsuitable for you. You are responsible for judging whether any session is appropriate and safe for you.

You must be at least 16 years old and able to form a binding contract to use Upform. By using the service you confirm that you meet these requirements.

You register through our authentication provider (Clerk). You are responsible for keeping your credentials secure and for all activity under your account. Tell us promptly at support@upform.ai if you suspect unauthorised use.

• Free trial — new accounts start with a free trial period. No payment is taken until the trial ends.
• Subscription — after the trial, full access costs CHF 20 per month, including a monthly allowance of AI credits.
• AI credits — AI actions (plan generation, adaptations, session revisions) consume credits. You can purchase additional credit packs if you need more.
• Prices are stated in Swiss francs and may exclude applicable taxes, which are shown at checkout.

Payments are processed by Stripe. By subscribing, you authorise us, through Stripe, to charge your payment method the recurring fee until you cancel. Subscriptions renew automatically each month. We do not store your full card details.

You can cancel your subscription at any time from your account; it remains active until the end of the current paid period and is not renewed thereafter. Except where mandatory law provides otherwise, fees already paid and AI credits already purchased are non-refundable, and partial periods are not refunded.

Credits are a prepaid allowance to use AI features. They have no cash value, are not transferable, and are non-refundable except where required by law. We may adjust the credit cost of features with reasonable notice.

You agree not to:

• Use the service for any unlawful purpose or in breach of third-party rights.
• Resell, sublicense or commercially exploit the service or its output without our written permission.
• Attempt to disrupt, reverse-engineer, scrape or gain unauthorised access to the service.
• Upload another person's data without their permission.

Upform relies on third-party services, including Intervals.icu. You are responsible for your Intervals.icu account and the API key you connect, and for complying with those services' own terms. We are not responsible for third-party services we do not control.

The Upform software, brand and content are owned by us and protected by law. We grant you a personal, non-exclusive, non-transferable right to use the service for your own training. The training plans generated for you are yours to use for your personal training.

Upform does NOT provide medical advice and is not a medical device. Endurance training carries inherent risks. Consult a physician before starting or changing a training program, especially if you have a health condition. You train at your own risk and are solely responsible for your health and safety.

We aim to keep the service available but do not guarantee uninterrupted access. We may modify, suspend or discontinue features, and may change these Terms or pricing, with reasonable notice for material changes. Continued use after a change takes effect means you accept it.

To the maximum extent permitted by Swiss law, Upform is provided “as is” without warranties of any kind. We are not liable for indirect or consequential damages, loss of data, or any outcome of following the training guidance. Nothing in these Terms limits liability that cannot be excluded by law (such as for gross negligence or wilful intent). Where we are liable, our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to comply with the law. On termination, your right to use the service ends; data deletion is described in our Privacy Policy.

These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Genève, Switzerland, subject to any mandatory jurisdiction for consumers.
